Buying a property during 498a

Querist : Anonymous (Querist) 06 December 2011 This query is : Resolved
Hi
my 498a case is still in progress while I want to purchase property under my name. will it be safe? what are the consequences if I do so?

she did not get any relief from her maintenance appeal as she is the owner of property and getting rent.

please advice

You are free to purchase any property, it has no bearing on 498-a case.

Only under 25 HMA, the said property would be of any consequence. We can cross the bridge once we come to it. Now as she owns the property, even it would not be of much consequence anyways.

if any Domestic Violance case filed against you and the property is sharehousehold then only she can apply for the property or possession for risiding, otherwise you are free to purchase property, Mr. Kapoor is also right

498A is no way concerned to the purchase of the property.

I endorse the views of experts.

Case u/s 498A IPC OR u/s 125 crpc is going to effect on the property.
However under the provisions of PWDV Act , the wife shall have right to reside on the properties owned by her husband.
So keep in mind about that fact.

I completely agree with views of All experts.

She wont get any benefits from the property you buy as she has her own property but still keep it a secret about your purchase.

Sounds great.

how about in my case where I was acquitted in DVC and divorced her, also she did not get relief as she also owned property.

can I as well invest in property?

Privacy in purchasing property is not possible at all nowadays as adivsed by Sanjeev.

The nothing to worry at all unless the order passed in DV case is set aside by the appellate court.

Fully agreed with Experts & specially Shonee Kapoor
As the Question is only related to property & 498.
Rajoo said "It had no concern "
Thats all.
Do not confuse him with DV Act, 125 crpc or 24 HMA, or 18 hama

I too agree with all.
