Party in person

Querist : Anonymous (Querist) 04 September 2011 This query is : Resolved
Many courts do not encourage the parties to appear as party in person, even if they are advocates. What is the reason for that?

No Problem if you have posted your query here.

I shall tel about Advocates appearing in person in their own case later but I discuss about lay-man first.

Once a lay-man litigant was arguing before a court in his own case. The judge told him to engage him a lawyer as he is unable to understand his argument. The litigant on this told to the judge to engage a lawyer for himself (judge) as he is unable to understand.

This is not a joke rather a fact that lay-man cannot be equated with law-man so generally courts do not allow litigants to defend their case personally.

Now come to second category of Advocates doing their own cases in person. Generally it is seen that they expect favour from court telling that this is his own case and court should consider this fact. This expectation openly being declared in court various times makes unease to the judicial officer as well as to opposite lawyer so also trial magistrate expect litigant advocate to be represented through some other lawyer. The possibilities of errors in own case are also common so it is also gud for such litigant lawyers to engage some other lawyers to deal with their cases.
