Transfering propert to grandsons

(Querist) 12 August 2011 This query is : Resolved
Dear Sir,
Is it possible that my granfather can transfer all properties(ancesstral) directly to me and my brothers. As my father is living separately and sharing no family responsibilities. What is the procedure? Is it possible through registered will by my grandfather forefeiting my fathers right in properties? Or there is any other solution by which all property gets transferred to my brothers and mothers name and father does not gets any share after my grandfather's death.

Thanks in advance,
BPM

It is simply not possible to implement your proposal.
It is also not clear on what basis (or for that matter what is your understanding) you say that the properties are "Ancestral"?

Dear Sir,

I meant to say that the properties(farming lands, gardens etc.) my grandfather have, were inherited (belonged to my great grandfather). Since I fear that my father may sell all the property after my grandfather's death (my granfather is 93 year old)so me and my brothers will not get any thing. So my question is how can I stop my father. Since my grandfather is still alive and willing to transfer all properties to my brothers and my mother's name, Is that possible? What is the procedure?

You have to give complete details.
Whether the property in the hands of your great grand father was his self earned or otherwise.

When did your great grand father die?
Whether apart from your grand father, your great grand father had any other children and if so how many sons?

When your great grand father die, who all got share in the property?

In which State the property located?

Apart from your father, who are all the children of your grand father? Whether all of them are alive or not?

Dear Sirs,

The propoerty I am talking about belonged to my great great grandfather (even he inherited that). My grandfather was 3 brothers, property was equally distributed among them. There is no dispute between my grandfather and his brothers. My grandfather is still alive. He is 93 year old. The property I am talking about is solely of my grandfather (the share he got from his father, undisputed).

My father is only son of my grandfather. Means my father has no brother.

The property is located in eastern UP.

So coming to my question again, Since I fear that my father may sell all the property after my grandfather's death, so me and my brothers will not get any thing. So my question is how can I stop my father. Since my grandfather is still alive and willing to transfer all properties to my brothers and my mother's name, Is that possible? What is the procedure?

Get a registered gift deed executed by your grand father in favor of your mother and her sons of all properties Agricultural as well as Abadi.Recital in deed should be there showing why your grand father does not want to give any thing to his son(i mean your father)
