Sale of Property

Querist : Anonymous (Querist) 10 April 2011 This query is : Resolved 
My father before his demise gifted some land in the name of we three sisters by the way of gift deed which was solely earned by him, he did not include my brothers name since he was not in good terms with my father & also with us, now can he cause trouble to us by bringing a stay or file a case against us if we want to sell the said land.We are confused

If the GIFT Deed in your favour was REGISTERED, then your brother(s) cannot do anything. But if the Gift Deed was not registered then, being legal heirs, they will also have equal share in the said property left behind by your father.

As the property was self-acquired property of your father and he gifted it to you and your sisters during his lifetime, legally your brother has no claim to the property.

whether gift deeds are regd.,? if not he may cause problems for you all. If it is regd., then no problem. Your brother may file a suit only with an intention to harash but that suit will be dismissed.

Gift deed once executed and registered, cannot be challenged afterwards.

Your brother can not challenge the gift deed.
