forged return of income.

My husband has (1) obtained duplicate Permanend account Number in my name (2) he has also filed return of income in my name with forge signature in my old PA Number. Now he has pleaded before family court that i have sufficient source of income. What can I do? please help me.

burden of proof you so you only prove it how did he cheat prove before the court. can you collect the evidence

If you are sure about what you have stated here, better tell these facts to your lawyer and he will file appropriate application before the Court. Further more, do you mean to say that even your signature in the Return was forged by him, tell this fact also to your lawyer.

Give the facts of forgery to the IT Department and the court.

It is a rave offence. File an application u/s 1656(3) crpc before the court and ask for investigation of that forgery. Your husband would be in great trouble.

A novel case, indeed, if that is true.

In proof your husband would have filed an acknowledged copy of the IT return also in the court of law. The acknowledged copy of the return would also contain your forged signature. Your advocate can ask your husband to prove your signature on the copy of the IT return.

Return if filed in the handwriting of your husband, in that case you can also request the court of law for forensic analysis of the handwriting and signatures on the return.

IT department can also be approached with the fact of the case for submission of false IT return on your behalf.

To apply an pan No. A singnature is required. That is forged signature. It has no valid. You plea mainly on this ground.
