What to do to apply i.p.c.217 & 218

L had applied under RTI to SPIO. Information not received by me in 30 days as per RTI Act 2005 I went to a FIRST APPEAL.
First Appellate Authority while passing order mentioned that SPIO has replied in time. He do so to save his junior officer from penalty under RTI ACT.

Can he be prosecuted under i.p.c.217 or 218?

If yes, what is the procedure?

How do you say that he has given false information. They would have sent by ordinary post. Please write to the appellate authority to provide the copy.

Sir, information is still not received by me even after 100 days have passed beyond time limit specified under RTI. In between many letters are written by me to SPIO with a copy to First Appellate Authority.

PIO has asked me to get the information from my housing society as per provision of bye laws & M.C.S. Act1960. I am asking my society to provide me the information since last 3 years & SPIO (Dy. Registrar) has also written letter 7 given direction to society to provide me the information.

But no information was received , hence I have applied under RTI

Sirs, please guide me to what to do ? so that action can be taken u/s 217 & 218 of ipc.

Should I approach higher officer of that public authority ?
