Parveen Kr. Aggarwal (Expert) 16 February 2010
Under the Hindu Marriage Act, regarding a valid marriage only three remedies are available. Either a petition for Restitution of Conjugal Rights or for Judicial Separation or for Divorce can be filed. Generally only one remedy is availed at any particular point of time. The Court may grant maintenance pendente lite in any of the proceedings. But the person in whose favour such order of maintenance has been passed can actually receive amount in any one of the proceedings.
