wrong termination

i worked for hdpi bangalore for five years.the company is a private bank.i worked in the bpo department.

i was terminated due to wrong feedback given by manager to hr department

i was on leave defending myself in 498a but the company terminated me saying i absconded. they have not given me any notice nor experience letter.

i was acquitted in 498a but the company say they do not have policy of employing thoae who are terminated.

i was terminated in 2008.

i was fighting 498a and 126 all these years.

can i restart my career in the same company and what to do to get my experience letter. thwy are asking for 40 thousand to give me my experience letter. i am jobless and on the brink of bankruptcy. please help.

2008! - you were terminated almost a decade back. Perhaps, you should forget the past and turn a new leaf!

Did employer mention any reason of termination in termination order?

Did it issue any SCN before termination?


In case your employment was terminated on wrong feedback , charge of some misconduct and without opportunity of natural hearing and in violation of standing orders applicable to establishment then order of termination was bad.

The establishment and employer is under obligation to supply in addition to termination order the correct FnF statement showing computation of earned wages/bonus/leave encashment/OT/incentives/reimbursements etc etc , FnF payout, service certificate, relieving letter, etc etc ............

Post full facts of the matter.

Do you have any irrefutable evidence of demand of monies (Rs.40000/ as posed by you)?


If you have copy of appointment letter, salary slips, PF a/c number and a/c slips of each year, Form16 of each year, termination order then all of these can suffice as good as service certificate/relieving.

Have you written under proper acknowledgment to good offices of appointing authority, MD asking to supply you the above mentioned docs.............

The good offices can provide relief to you and even may take you back in employment, by their sweet will.

Thee is NO bar on them.
