Pedhinama- family tree to enter legal hiers name in agri. land

one my friend's father had agri land in villege. now he is passed away and coz of dispute in villege. no one is ready to be in pedhinama made by talati.

so can apply and use succession certificate
to enter names of legal heir in agri. land

or any other way

Legal heir certificate/Family heir certificate whatever is applicable at your location shall contain names of all legal heir.


At many locations legal heir certificate is issued after inquiry by revenue officials e.g; Kanungo, Patwaari.



The applicant should be truthful and if asked should give names of all legal heir.

Talati or Patwari is ready to make legal heir certificate we call pedhinama in gujarat.
but issue is we need 3 witness from the village as my frnds family is having dispute with in village so no body is ready to be come witness. so my friend told me to go for succession certificate.

so i want to know can i use succession certificate for immovable property and how to obtain and how much time it takes

U need to make application to the local court where the property is located.
Succession certificate is granted by the court to the legal heirs of that property.

1. "Legal Heir Certificate" obtained from any authority is grossly insufficient for purpose for transfer of immovable property.

2. "title-ownership" of immovable property CANNOT be transferred based on any "Legal Heir Certificate". Proper due procedure of law and documentations are required for transfer of immovable property.

3. After following due procedure and documentation with the Talati office, move appeal before the local collector office, who would issue directions to the Talati, to do the needful.

FURTHER, one of the experts here, seems is grossly myopic in understanding "he with she" and has a chronic habit of making allegations and who is extraordinarily ignorantly ARROGANT with an Unruly Mental Itch. Not good in a Legal Profession. Must desist from such habit-forming nuisance.
