Daughters right in the inherited property from grandfather.

Dear Sir/Madam
1) I need to know my right to the share in property acquired by my grandfather.
now my father is going to write will in the name of his son.
Is it enforceable by law?

2) Is it salable without my signature?

3) Do i have right to claim equal share in that property acquired by my grandfather and inherited to my father and mother.

Kindly give advice for these above 3 questions.

Probably by Grandfather in our query you mean; paternal Grandfather ( father’s Father).

It is believed that you are all, Hindu.

If it was self acquired property of Grandfather, then it is not ancestral in the hands of your father.


If your father has inherited it from his father; then nature of it should be; Self Acquired in the hands of your father.


A Hindu man can dispose his self acquired/absolute property in anyone's favor in his life time by a valid deed.
NO one has any forced share in it.

If it was self acquired property of Paternal Grandfather, then how can your mother inherit it?



Daughter in law (your mother) is not coparcener in Father in law’s (your Paternal Grandfather) property.


If she has acquired it by say; some valid Gift deed /WILL then then nature of it should be; Self Acquired/absolute in the hands of your mother.



A Hindu woman can dispose her self acquired/absolute property in anyone's favor in his life time by a valid deed.
NO one has any forced share in it.

if your grandfather died intestate, you have right in his property. The share of you depends on so many factors.

If your father/mother got the property under any testament, Mr. Kumar has advised you well.

Self acquired Property of Grandfather would be inherited by his legal heirs if he expires intestate.

Father can bequeath a will in favor of his son for the property inherited by him.

You can not object during life time of your father.
