We are three daughters to my parents no son only daughters. My father is a retired govt employee. My father and mother are alive. My father is having some ancestral properties and 2 nos govt alloted property.now a days my father is putting all tge properties in cort cases and spending lakhs of rupees to court cases. Now he is trying to sell one governament alloted site .i am the elder daughter can i stop my father for not selling that property

The name Rajarao cannot be a girl and daughter of his father. Evidently, he has shown him as a daughter to hsi father just to seek solution to his academic query.

Even though may you be a daughter, you cannot do anything from selling his property.

Please ascertain the conditions as to Government allotment. Also, how the property is ancestral!

legally your father is free to dispose off his properties he likes but morally this is your duty to get the disputes settled amicably so that he may not do so.

It seems that his cases are running against you, however, you have to clear the doubts by posting clear facts.

It is believed that you are Hindu.

Self acquired; You have no forced share.

Govt. allotted; Go thru T&C attached with such property.

Ancestral; You may succeed for share.



A father having 3 daughters may not want to decline share.


Assess the reasons and make up and cajole the father.


Father may agree to share with all daughters.

Your father is owner of the property he can sell / gift / mortgage / bequeath a will for his property, you can not stop legally.

Well observed by expert Mr. PS Dhingra, I agree; it's pure academic query wherein the author has posted the quetion for the mental exercise of the experts like an examination question paper.

How can a person allotted government accommodation (during service time-meant for its servants) dispose of government owned property?

Can an employee be allotted and retain TWO properties, that too after retirement as stated by author, when there is long que/waiting list for allotment of ONE accommodation/ quarter/house/bunglow??

The author did not mention qua other properties and their status, as stated to be "ancestral" ??
