Sir,
My brother along with my whole family have been accused in false Dowry (498a) and Domestic Violence (DV) cases.
After 3 years of filing the DV case and after a lot of persuasion, Complainant (wife) has submitted an Affidavit in the court which is nothing but photo copy of her DV petition.
Most of the statements are untrue and many things she has hidden in her statement.
My questions are.
1. In what stage the case is?
2. Is it evidence submission? Becasue she has not submitted any documentary evidences except this affidavit.
3. What is the next step after this?
4. What should be our strategy for her false statements and hidden facts?

It is evidence affidavit. You have to cross examine her to prove your case. What to cross examine it can be said only after going thru., an affidavit filed by your wife.

She can file any documents through any other witness.
If you have proof for her false statement, file a petition for perjury in consultation with your lawyer.

1. Does evidence affidavit follow examination-in-chief or directly cross-examination?
2. Do I need to submit a reply to the evidence affidavit?
3. Is it possible that no supporting documentary evidence is submitted along with evidence affidavit by prosecution. If yes what does that mean to me?

I thought of replying,but even after receiving sufficient suggestions from the above legal experts,the querist is still adamant in reproducing his original post(Cut & Copy).Hence the query could be termed either as vague or academic.

None of my question was copy/paste and answered already.
I requested experts in expectation of more details which will help me to fight fake case against me.
I am not adamant but unfortunate who is implicated in many cases and has to run around the courts to prove his innocence.
