Dear Experts,
i had filed a divorce case exactly a year ago, the other party is not receiving the notice or even giving a MCD, we have sent the notice to the address they are staying but wantedly they are not accepting the notice, now what is the procedure for a ex-parte divorce and how long should i wait for filing for paper publication o.
can some one guide me on this please.

Hi
If you are convinced that the other party is avoiding receipt of notices and you have proof of other side returning notices, then you can file the same(return of notices) in the court and ask for ex-parte divorce

Serve through alternate method of service and proceed accordingly afterwards.

Thanks for the Replies experts...i am 100% sure that they are staying there and returning the notices, i got this information through one of their relatives who gave this address and confirmed
alternate method of service like????
i do not want to see their faces again in my life, they have spoilt my career, stealing every single thing from my house

Please clarify- have u filed suit for divorce? If so the court will issue summons to the defendant normally by registered post with ACK due to be delivered to her at the address given by you in the plaint. If the summons are returned by the postal authorities with remark "addressee not found" or "Addressee shifted" then u have to apply for substituted service by publishing the notice in the news papers and affixing the copy of the notice on the premises where she is known to reside.

Thanks Mr Gupta, i have filed for divorce in Dec 2014 and they are not receiving the notices also we found the company she was working and sent notice to the company and imm she changed the company too. this info was available on FB and by their relatives
