Withdrawal of money from atm

In March/2014, Rs. 40000/- was withdrawn from my savings bank A/C with SBI, Malad. through ATM wherein ATM card was with me.Money was withdrawn from SBI ATM at Panvel.Subsequently very next day I launched the complain with Bank and also lodge the FIR with concerned Police Station. I made an appeal in Consumer Court also but it was not admitted citing reason- "no deficiency in service". Bank is not taking any interest. Can you pl guide me with RBI ruling in this regard. Also could you pl guide me what to do now. Its matter of hard earned Rs. 40000/-.

Have you Taken Acknowledgement From the Bank While Submitting The complaint Of Misuse of your ATM.Consult Your Local Good Senior Advocate and Proceed to high court.Claim the amount with Interest and Court expenses and advocate.Initially you will have to bear some Strain and Pain For the result.

The ATM card was probably cloned.

Bank is liable for cyber/IT frauds.

You can move to consumer court of Banking ombudsman.

I had been to Consumer Court. It did not register the case . what next?????

If you so desire, you may appeal against the decision of the Consumer Court. But the chances of your succeeding are very very rare. You should be very careful while using the Card.

The RBI Notification mentioned by Mr. Rajendra K. Goyal has no application to the situation in the present query.

You have as per your post lodged complaint with Bank M/s SBI and FIR with police.



Has the bank M/s SBI issued a complaint number and a written reply to you?


Has the police updated anything to you?

Have you tried to obtain status thru RTI?


In short what is the response of the bank to you on record/in writing?
