I have submitted RTI appeal on August,2014.The order was passed and the first Appellate Authority directed the Public Information officer to give all the information as desired by me, but till the date there is no satisfactorily answer been provided by the PIO i have made rigorous follow up but no such heed is taken by the PIO,Now according to the RTI Act section 20,18,20(1) there is a penalty for PIO of Rs.250 per day for the delay.Please help me out how can i take out the penalty from PIO? what is the procedure for it? to whom should i claim the penalty?

File Appeal(second)to the state information commission and request for penalysing the PIO for his dereliction in duty.

It is the state commission which is competent to impose penalties and award compensation in second appeal/complaint.

File second appeal asking for implementation of the orders of first appellate authority. Are you interested in getting the information or in imposing penalties on PIO? Awarding penalties is the job of the second appellate authority and he will take care of this aspect while disposing your second appeal.

You have to bring it to the knowledge of the appellate authority.

the appellate authority will be the senior officer than that of that PIO. He is having power to direct the PIO to comply his orders.

If the appellate authority rejects your request, you can go to Second Appeal. At this stage you can not go.
