Recovery of salary

can i give complaint under wages act or any other act for recovery of my salary which is due for 6 month . my salary is 80,000/ p/m hospital managements is habitual to use the doctor and avoid salary there are many doctor awaiting for salary and management is in good condition

1. Why are you working for such a long without any salary, if it is not charitable or for social service?
2. Decide fast to continue working in the same situation, i.e., without salary.
3. If salary is not paid for 8 months without any cognet reasons, issue legal notice and file recovery suit.

You have only repeated your stand in second post. Do you have any appointment letter on hand? What are the terms and conditions of the appointment letter? Many Doctors work in hospitals without any written commitment as it is an extra income for them and for some other obvious reasons. Are you one of such doctors? If you have appointment letter of hand, you can approach an advocate with the appointment letter and proof of non-payment of salary (like your bank account etc.,) and serve a notice for immediate payment of arrears of salary. You need not have to worry about under which Act or under which section you need to take action.

no your are beyond the proscribed limit of wages under the Payment of Wages Act, However, you can file civil suit for recory of money in civil court.

You may show the contract/appointment letter to your lawyer and also the list of charges that hospital pays to doctors contracted/employed by it and duties/work/consultation rendered by you, to your lawyer..

The doctors association might help you...or you may have to approach court....for recovery..

If you do not have any proof for your appointment on the monthly salary basis or for your employment, or any other proof that you were associated with the hospital on paid services, or the hospital management was paying you the monthly salaries till then by case for which there was no account except to take your signature in a small note book held by them etc., you have less chances to extract the arrears from the management. However, issue a legal demand notice for this and wait for their response. After that you may think of next course of action.
