payment not received

Querist : Anonymous (Querist) 24 November 2009 This query is : Resolved 
I purchased a car and gave it to somebody else on a promise that he will be paying me intalment plus Rs.2000 per month but now he is not paying money from last 4 months and not returning the car even, I have this in written. Please advise what to do?

Give him a legal notice calling upon him to return the car and pay the due amount. If he don't comply then, file a suit for the recovery.

I suggest you file a criminal complaint of cheating against the accused u/s 420 IPC
