I am office bearer of society and one of the member seeks permission from committee to celebrate birthday function at refugee flat. Some members are having strong objection and challenging us that it is against law and they will take legal actions against the committee. My question:
1. Can we deny permission to the members to use refugee flat?
2. In spite of denial, if a member uses refugee flat, what action actions can the society take and how much can be the penalty as per law?
3. Can other members legally challenge committee for use of refugee flat?

If your bye laws prohibit use of refugee flat for private function purpose, you may not allow the member to use the same, if he still goes ahead, you may take action for violation of rules as envisaged in the bye laws of the association. Since you are the office bearer of the society, you can very well inform the president/secretary about this and to issue suitable instruction to the member to avoid controversy on the issue.
