Banker hiding the data under rta act.

respected experts,

i am requesting the information under rta about education loan a/c since one year,they are reluctent to provide and sending regd post stateing it was 10 years old a/c,but where as two years back also banker send me a demand letter.

wantedly banker is avoiding to provide the data,what is the option is available for me to get the data,kindly guide me.

File an application u/s 6 of the RTI Act, 2005, get the information and proceed as advised by your lawyer which you will have to engage.

Even if it is 10 year old the Banker has to provide the details taking sufficient time and necessary charges.You just submit a simple letter not even RTI stating unless these details are provided you will not be in a position to make further payment or settlement and take an Acknowledgement with Banker's Seal and Signature and wait for the result

Send RTI. If the Banker is not providing full information i.e copy of all your loan documents, account statement from the date of loan till date file appeal under the act.

Meanwhile write Registered letter to the head office, Regional office, RBI and also copy to Branch with repeated weekly reminders for instructing the Branch to provide the information about your education loan account. Repeat the procedure every two months till information is received.

If you donot get proper response from bankers, you may approach the Banking Ombudsman seeking necessary relief.

There is limitation for retaining documents in the Bank, go through the Bank Rules, in most of the cases the documents are destroyed after 6, 7 and 8 years (except few)please check yourself and proceed.
Seek services of a local lawyer, if you feel, it would be beneficial for you.

If the loan is still running, banker cannot destroy documents or details of such account and moreover, the retaining period is 10 years even after closure of such loan account so banker cannot take shelter of such vague and illegal plea. Make representation to the higher authorities of the concerned banker failing which file a writ.
