Cheated by girl and her family

18 month back I married with girl in temple,in presence of my parents and relatives.temple did not provided marriage certificate.Girl did not inform about our marriage to her family because we are intercaste and time she was studing .i told lot of time that inform about our marriage to their family but every time she made Excuse that after her job she will inform.Suddenly 15 days before she told me that her father asking for marriage photo(she asked these thing call as well as msg,i having the msg) and also taken all photo and copy of master CD.and after one week she told me that her parents not accepting our marriage.they want to marry their daughter in their own caste.
I am totally blanked after listening their word.....I told her if she want to marry again she must have to take divorce.
I have only witness of my marriage and have same tour photo,and some photo in which she was with me and put sindur.
Can law help me to fight from these type of cheater.Girl and her family played with my life they threaten me that they file a rape case against me if i will and take help of police .can with the help of law I will get justic.
plz suggest me...

You can definitely file a petition under section 9 of HMA and can also go to police authorities if she is going to re-marry without taking divorce.

When you are left with no evidence of marriage not even any temple receipt and the marriage is not legally registered as well it is even can not be proved as live in relationship also since she had carried away all the photos difficult to prove you had an affair.Legally she is strong and it would be difficult to stop her marriage and there is no question of divorce required from you.Since you both inter caste it may invite more problems for you if you interfere with her now.For your good better forget her.

Yes, you can file for RCR ask for injunction so she can not remarry in the meantime.
The photos available with you are enough to prove marriage.

Try to get other copies of the marriage photos from the photographer engaged. May file RCR.
Contact a local lawyer.

2.a diary in which she told about marriage
3.Phone msg by which she told me that her father asking for marriage photo.
4.call record in which she accepting about our marriage and she also accept that their family member putting pressure to marry again
5.lot of facebook msg also with me.
6.witness of marriage
can these thing are not cosidred as evidence....?

Properly advised by experts. You can file a RCR and also lodge a complaint against her parents with the police stating that they are forcing her for second marriage while they very clearly know that she is already married and have not been divorced.

Anyway it is your life and you have aright to ruin the same.
The girl who can be compelled to marry elsewhere she can even be completed to depose against your version and give evidence in such manner that may be sufficient for your conviction.

but i have one qestion all law is made for girl only.from last 1.5 yr we will like a husband wife.and when her parents having problem of defaming & forced her to marry with a guy of same caste is rigth things.,,,?
if the same condition is happened with a girl then you blamed boy and same thing happened with boy you again blaming boy.
is this is our law....?

1. Why has the girl gone against you?
2. In such circumstances, whether you think you can live happily together?
3. If so, then rather than getting into court cases, get in touch with some respectables of society and talk to girl face to face.
4. If point 3 fails, rather than putting Sec 9, better ask for court assisted mediation.

your wife does not want to stay with you . her family has threatened you that they will file rape case against you if you take legal proceedings . your inlaws wants your wife to remarry .
best solution would be to go in for divorce by mutual consent .
