Hi, my self rehan, iam staying in Gulf, i got married in 2013 Feb.it was a arrange marriage. My wife is very egoist. Very short temper. All my problems started when I ask my wife about the lavish expenses which she is doing from my savings. She always wanted me to do what she wants in her own way which I don’t like. she always wants me to support her family which also I don’t like. then one fine day she told me that she don’t like me and my home and my parents because we are not up to her expectation.( giving away full money to her and we should not ask any count for that).then she left my home by saying that she wants to see her mother and sisters, then my parents let her go, then her family full brain washed her. then she came with her family and taken away all her jewellery and cloths stating that she does not want to stay in my home since its not up to her expectation.(she always want a home which look likes in movies and TV serials) Then I called my wife and tried to convince her. but she was not able to understand me apart from that her family including her sisters and mother abused a lot stating that iam not able to meet their expectation in terms of giving money to them. now I realized that they given their daughter to me to use me as an ATM card. After few days my elders went to bring her back but their family was not willing to send her to my home, my inlaws did full publicity that iam not treating them well including her daughter, but fortunately every one knows about my family and about them very well that is why people simple ignored them, then again afer few days my elders went to bring her back fearing the reputation of my family now this time they simply blamed me stating that iam impotent guy. (because they don’t have anything to blame,,, I know myself very well what iam not at all impotent, iam ready to visit any doctors to get medical fitness) Now they are asking for compensation for that, then I called my in-laws and their relatives and I said that iam ready to come to prove that iam not impotent, then they changed their version of the story because they faced the heat from their relatives also, now they are asking compensation for marriage expenses. Her family members are threatening me that they will kill me if i will come to india,my mother in-law threatening me that she will lodge a complaint against me (probably 498 A) because she is having some support from women welfare association. They are now proposing divorce (khula which is commonly known in Muslims) from their said ,i love my wife a lot. That is why i bearded all the pain till date, because of this tourture iam not able to work properly in company .now i decided to come on short vacation to India so that i can resolve all these issues .now my questions are .
1.what if i will come to India (they can do anything to me legally???? my wife is not with me or with my parents since i left her in my home, in fact myself and my family treated her very well. what are the chances that they can book me under 498A ????)
2.i have the messages and voice recordings in my phone, which are from their family where they are threatening me of my life(what action i can take against them legally ????)
3.since they first proposed the divorce( khula as per Muslims) whether i have to pay the cost of the marriage expenditure ?????where as i also given grand reception (Waleema) to there family and relatives, can i ask them to pay my expenditure in return of that???????????
4. since they did the publicity that iam IMPOTENT guy. Can i take any legal action against them ??????????
5.can police confisticate my passport ????
6. can i approach Human right commission for the mental torture which they are doing to me?? Or shall i lodge a complaint against them as soon as i reach India first so that police can know the actual truth?????????
7.Can i take any legal action against my in-laws. from my current location without coming to India then what is the procedure for that??? What are the possible all actions i can take from my side ????????

Dear Experts,my sad story continues with my old story which i before posted last time,with the same tag,one of my family friend advised me to call over a phone to my wife so that i can settle the issue between us,because iam the one who is suffering alot with this matter, i called my wife to resolve the issue(she left my home 3 moths before,she wanted to be separated from me,she is the one who is proposing mutual divorce (khula in muslims),then my wife did not answer my calls after several attempts,then i tried a lot then she picked the phone and given to her younger sister(who is not married)she abused me alot along with my family which i cant explain you in words,being a girl no body would expect those words from her,then i recorded each and every word of her,and her mother(who was teaching her word by word from back,which clearly one can listen in recording)after several request i made to her that i want to speak to my wife in the recording she clearly states that my wife left me and she does not want me any more,she repeated this words so many times in phone recording,she also stated that her family need money(which is extortion from their side,they want me to pay the marriage expenses, they want to claim from me)
she abused my mother also with very bad words,now my questions are,
1. iam currently in gulf country may be with in few months i will be coming to India,
can i approach police to book a case against them?? then which sections are applicable??
2.Can i use this recording as evidence that all they are doing this for only money and defaming me????
3.Can i use this recording(sister in laws) and text messages and recordings which are threatening messages that they would kill me if i will come to india(from her uncle who is now in other country which he send from his mobile from other country)what action i can take against him ??????
4.Can i use this as a evidence that my in laws are torturing me mentally,so that police will not file any baseless cases against me,so that i can save my family and my self from my inlaws trap(498A any other which ones in laws normally would do)
5.Can i obtain a written statement from my inlaws as well as my wife in presence of police that they would not fill any cases(498A etc etc) on me only for money,and will not harm me and my family,so that police would be also aware of their cruelty, then what is the format of the statement ????
6.Can i approach HRC with this proofs with the help of media?????
7.last one how to handle the local police ???? because if they will find that a person is NRI,then they will make their won dramas for grabbing money from BAKRAS like me???????

1. Talking to them is better option. Use police as last option. Putting sections is the job of the police not yours.You simply make the complaint.
2.Yes but court ignores it before trial.
3. Yes as said above. YOu can show to Police anyway.
4. as above
5.Such undertaking has no value. The case can be filed in spite of written undertaking.
6. Nothing would be done.
7. Engage a good and trustworthy lawyer.

Khula is a sort of divorce by Mutual consent- is consideration given by wife to the husband in exchange for divorce under Muslim Law and not the other way round,.. Also, seek anticipatory bail against 498 A criminal proceedings.Also file a police complaint and complaint with the State Human Rights Commission alleging blackmail and torture ON TH PART OF YOUR WIFE AND IN LAWS and seek compensation. If your wife likes to rejoin you- approach a District Court and apply for settlement of your difference by Lok Adalat- and the Lok Adalt would try for settlement of your differences amicably and get the matter settled in accordance with law under the C.P.C and such a Deed of Settlement arrived at and recorded through Lok Adalat has full legal validity and enforceable in law.
