prabhakar singh (Expert) 18 October 2013
There was never an Act called'Hindu succession Act 1865'

It was 'The Indian Succession Act, 1865 (Act X of 1865)' and it was repealed.

It is Hindu succession Act 1956 that governs intestate Succession cases under which when
a male dies intestate his property devolves
upon who ever is alive among his mother, widow, sons or daughters (married or unmarried).

Coparcenary has nothing to do with your question. So also Hindu marriage Act or it's section 8.

An act conferring right would have a section but there would be no section for not conferring a right.

Read chapter II of the Act to understand intestate succession among hindus.

One thing more the style and language of query reminds me of a beggar in my street who begs as
if he is criminal entitled to ransom.

using 'kindly'does not show humility when sentences
show commands.

From next time do not put a query without fact and do not come to discuss text law here.

Senior Mr.Prabhakar Singh well advised. But I request him not to be so harsh on the author though the query is not practical and without polite language.
