Minimum Time or Date for Adjournment

(Querist) 14 October 2009 This query is : Resolved
I have contesting a civil suit outside the district but the court of Civil Judge [S.D] has giving the date of 10-15 days only while I am opposing to that each and every time. What is the way to get the time of minimum 30 days for adjournment ? How much time the CPC have provide to us for the adjournment ?

i dont think there is any such law/ provisions prescribing minimum period of adjournment....its a prerogative to court to adjourn the matter for a reasonable period so that the interest of justice is not defeated.

lets c what other Ld. members would say.

I also think the same way, there is no such law prescribing minimum period of adjournment. It is on the court to adjourn the matter for a reasonable period.

As you said you oppose the court, it would be better if you request the court with some valid reason for more time in adjournment...

No prescribed adjournments for the argument. and at present courts are not giving the adjournements hardly 3 to 4 days are giving for the arguments because they are worried about their completion of monthly quota

Courts are now trying to dispose off the cases as soon as possible so it is in the interest of general litigant if case proceeds fast. Better u engage some local lawyer for ur assistance because there is no provision in CPC to help you.
Adv Archana Deshmukh (Expert) 15 October 2009
There is no no law or rule prescribing minimum period of adjournment. It is the discretion of the court. So, all you can do is to request the court, if it is inconvinient for you or engage a local advocate to assist you.
joyce (Expert) 15 October 2009
there is no such norm, but engage a local lawyer and u can be present only for the significant stages of case to carry the process.

There is no other way except request to the court, and also other side counsel.
