You have to come out with details.
Are you from bank side or are you the nominee.?
When did the account holder die?
When was the cheque cleared?
When was the intimation about the death of the account holder received by the bank?

If the bank has no information about the death of the account holder, it is not liable to any body for payment cheque in a deceased account.
