(Querist) 26 January 2013 This query is : Resolved
Can brothers entitle for a share self acquired properties? The logic given is father gave you the
education and hence you acquired those properties.
And also they were purchased before family was divided, which happened in 2000. Therefore, we are entitled for the shares.
(2) Also, if I leave my property in the possession of my brother for
longer time,  will there be problems in future.
I request for your comments or advises on these issues.

1.Law is not in favor of logic advanced.Self acquired property shall not pass on as share to brothers for any reason.

2.Yes!It may create problem in future.Possession is 9 point in law.In future they may succeed in pleading the logic they are advancing on the ground that after acquiring the property you put it into the hotch potch of undivided JHUF,so after that the very character of property stood changed.they may also dare to stake a claim by adverse possession.
