hello experts..my que is that if a person worked in a private company for long time and he took his voluntery retirement but his boss is delaying his full and final settlment..he has the copy of finished work last assigned to him and the letter in which the money which he should get is clearly mentioned along with sign of appropriate official person..den what shud he do to get his money from the boss?pls rply

send reminders . wait for some time . then contact a local lawyer .

Dear Mr.Shrinath,
I do agree with Mr.Sethi. However,if you are not getting any reply from the company regarding payment after one-two reminders, then you will have to send a Legal Notice through a local lawyer so as to recover your legitimate dues. After that you can file recovery suit in the civil court or if you fall under the labour category then you can approach the labour court also. Last option you can even file a petition for winding up of the company.

And If no heed is paid to even lawyers notice,you have only one option that is to file a suit of recovery which must be filed with in three years from the date of letter that admitted your dues.Time consumed in correspondence shall not be excluded and even a single day delay beyond three years shall make your cause barred by law of limitation.
