Complaint in caw cell

My wife filed a false, frivolous and baseless complaint in CAW Cell East District, Delhi against me, my mother and younger brother not against my father. Complaint is false to an extent that my father-in-law came forward and gave a statement in CAW cell that complaint of her daughter is false and baseless and there is no demand of dowry or doing cruelty to her duaghter. Please advise whether in this situation also FIR will be registered or not where my father-in-law has given the statement in my favour?

Hi Gurjeet,

If your father in law has gone to the extent of saying that the case is frivolous in the Women Cell - then there should not be any registration of FIR. However always expect the worst as far as criminal justice system is concerned. For your own safety - seek a notice bail - at any event you'd be able to get 7 days pre-arrest notice in case of registration of FIR. This would put you in a greater bargaining position.

FIR may be registered against you and thus
take AB from court.

This is the best case wherein the police shall have to enquire the case in depth prior to initiating FIR and even if the case is registered, you shall get the benefit of the statement of your father in law on each occasion may it be bail matter or final hearing.

First of all file an RTI and get all the statement and documents in you possession, in future this statement will be destroyed, this is the best ground for your acquittal, if any case will be file against you or your family members
