Consumer related notice format

Dear Experts,

i want to go consumer court for filling service related issue, so i want small clarification before file consumer forum, i must give notice to opposite party ( one Company) and how many days i give to time for reply, that company in Rajesthan, i am from chennai. if you have any format for complaint and filing procedure kindly provide me.

give 15 days notice . wait for reply for 15 days . . you cna file complaint mentioning the facts of the case ,

the deficency in service alleged reliefs claimed . in addition an application for interim reliefs have to be filed . complaint has to be filed in quadriplicate .

Please note that giving notice is not at all mandatory.
However if you choose to send any notice you can give them any number of days of your choice.
If the company has ny branches in Chennai then you can file case in Chennai. else it is better to go to Rajasthan unless documentary proof of cause of action in Chennai

1.You may give notice of 30 days though it is not mandatory.

2.Format of complaint is given in last pages of CPACT.

3.Procedure is simple and there is some nominal fee to be given with the complaint.

The format of complaint is also exhibited on the notice board of the Consumer Forum with clear instructions regarding the documents to be enclosed, fee payable etc. I agree with the other observations made by the experts.

Hi all,
There is NO provision in the entire CPA which makes it mandatory to serve a notice to opposite party before filing a complaint under the Act,therefore why waste time (15 days/30 days or more ??)Mr.Shiekh file a complaint directly if you have a cause of action.Rest assured your complaint will not be dismissed on account of disability of serving a notice.

It is always advisable to issue notice as sometimes the problem can be resolved without going to court.
