What you did was illegal, don't ever repeat that.

The without tension divorce is a Mutual Consent Divorce only.

Yes go for divorce.
If you do not get visitation of your child then you have file case for her custody.

yes, you can go for divorce on the basis of cruelty.
Deepak Kamble (Querist) 24 April 2012
can she apply for podgi?
prabhakar singh (Expert) 24 April 2012
You both can go for mutual divorce as she is demanding and you are ready to give her divorce.

The custody of child would be given to her with visitation rights to you.

Yes!
She can demand podgi lumpsum or on monthly basis.

Maintenance is her right for which she can apply even after divorce.

I suggest you to become ex-parte in the divorce petition and let the divorce petition passed. It shall not only reduce your economic liability but shall take least time in the decision of the pending matter.

So far as custody of your daughter is concerned, you can file a separate petition after some time of the decision of the divorce petition.
