Picture of phyiscal imtiacy

(Querist) 22 April 2012 This query is : Resolved
wife has accused husband of demanding dowry and avoding sexual relationship with wife since he dowry demand is not met.

can husband show picture taken at time stay in hotel at time of honeymoon in court as evidence without attracting any provision of law against him. He want to prove couple did have physical realtionship and their stay during honeymoon and afteraward was good, including sexual realtionship.

Nudity, blackmailing , showing picture which are meant to be private and never shown in public.

For the sake of evidence it could be exhibited.

There is no need to put such pictures on court file as the private life of the husband is wife is not meant for showing it publicaly. As soon as you put such evidence on file, it becomes public document.

Putting such pictures is not of much help. Simple denial shall be sufficient for you to perform your onus. Let your wife prove how and in which circumstances, you didn;t perform your part.

deny the allegations that dowry was demanded and false allegations that you refused sex .

let her prove the allegations . dont produce those pics just let your wife know that you have some pics of your honeymoon .

I think you may not need to prove these photos....though at some stage these photographs may become relevant.

but let her first prove her own case...the allegation that you are avoiding sexual relationship are not easy to prove.
enjoylife (Querist) 22 April 2012
i dont intent to produce such picture in court of law.
But my parents are facing criminal charges for something they have not done.

ajay sir, if I let my wife know that I have some pics of honeymoon. Would it amount of blackmail to withdraw false case.

ajay sethi (Expert) 22 April 2012
no it does not amount to black mail . in causual converation you cna mention to her that you have proof that allegations leveied by her of no sex are false .

in criminal cases the burden is heavy upon the prosecution So let ur wife prove the allegations made against u first.

First of all a photographs is not a primary evidence. Any way you may have physical relationship with your wife at the honeymoon it doesn't mean that there is still such relation ship till date. Producing those photographs is the creziest idea i ever experienced in my entire career. But what about demand of dowry? Concentrate in the point of dowry. Demanding dowry is a serious offence. Don't take any crazy step without consulting you're lawyer.
enjoylife (Querist) 22 April 2012
thank you all for response.

I have not demanded dowry , i am accused of demanding dowry, and withdrawing from sexual activity with wife due to demand of dowry not met.

I cannot disapprove what she is saying apart from medical test for her and mine. Also, I agress with the with your logic," Any way you may have physical relationship with your wife at the honeymoon it doesn't mean that there is still such relation ship till date. "
but how can i disapprove this in court of law.

Wait and decide on the time.

Most cases get resolved before evidence stage. Hence use the same during cross.

Though you can mention in the WS etc that you have some intimate photographs which can be provided to court in sealed envelope if the court so desires.

Concentrate your attention over the real issues of the case rather on photos.

Dear Querist,

Are those pictures of both of you together,If so who has taken them. These things are not a valid evience. You will only be adding negatives to your case.Just think about how to come out of the allegations.
