Short amount lying in epf a/c and pf withdrawl

Dear Expert,


I have joined in one Pvt. Ltd. company in the month of Mar'10 and the company was considered me for PF from Jul'10 on wards. From July'10 till my resignation (i resigned and relieved in the month of Aug'11) company has deducted Rs.780/- per month as a EPF Employee contribution. Till 31-Mar-11 company has deducted Rs.7,020/- from me. But as per EPF Site my amount is showing as Rs.5,021/- only til 31-Mar-11.

Actual due date for PF Annual Return is 20th April of the subsequent year. The company has filed the annual return only in the month of JAn'12 for FY 2010-11 (actual due date is 20-Apr-10). During my tenure in the company company was not provided the Pay slips also. But the company was credited the salary in my bank a/c directly (by ECS)

for the short of my PF balance company was not said anything. I have sent a mail to the company also but i have not received any reply.


I have send the PF withdrawal form also to the company but the company was not been submitted to the PF Office.


What remedy i can take against the company.

you can complain with PF authorities. It is against the provisions of EPF Act and employers is liable to be prosecuted for the same.

You can directly file a FIR in name against all the concerned officials of the company under section 409/420 IPC or can make a complaint to EPF authorities to do so as this is very serious criminal offence on the part of officials of the company.

One you move such complaint, the officials of the company shall have no other option but to appease you and make you ready to withdraw your complaint.

You can send a legal notice to the company, showing all the deductions and why the same has not been deposited with EPF/
