Hi,

brother cheating sisters by promising money and transferring fathers property and later denying to give the promised money, what can be done legally.
please advice.

The query lacks details.
It seems a civil dispute.
File a suit for partition , injunction and accounts.

my uncle told he will pay a fixed amount orally to my mother and four of his sisters and made them sign in the registrar office and transferred my grandfathers property to his name and later denied to pay the told amount, my mother abd her sisters are very much dissappointed. what can be done
Devajyoti Barman (Expert) 04 December 2011
Case for cheating would lie.
A civil suit for recovery of money would equally be an option.

thank a lot devajyoti, could you please tell under which section this can be booked

criminal consequences will fall under cheat and breach of trust.,

and before court of law all of the sisters jointly can challenge the transaction which is before the registrar office.,
prabhakar singh (Expert) 04 December 2011
I guess promise to pay was oral and registry
of relinquishment was registered without containing any promise then i view that you hardly have a viable case, please do not mind harshness!!!!
prabhakar singh (Expert) 04 December 2011
Appropriate advise may come from me only on perusal of the deed!!!!!!!!!
Advocate M.Bhadra (Expert) 04 December 2011
Criminal case does not lie without documentary evidence of cheating,if their father died intestate then the said girl should file a partition suit against her brother in Civil Court.
Dr G V Rao (Expert) 06 December 2011
Agree with Prabhakar Singh that no case exists, when their is no proof / evidence that his uncle promised. Such cases are plenty in Hyderabad where sisters have come out against brothers on such pleas after land rates appreciated. None succeeded.
