Hindu marriage

D/Sirs,

Is Witness necessary for the valid Hindu marriage. If yes then how many male/female?

It is not like a muslim marriage where in a nikah 02 males or 01 male and 02 females are required.

Since now a hindu marriage is required to be registered with registrar of marriage for which states are to make rules, it has been ruled that a hindu marriage can be registered before registrar by both the parties appearing before the Registrar along with their parents or
guardians or
other witnesses
within one month from the date of marriage.

Then requirement of the witnesses arise for registration purposes that only when spouses parents or guardians are not appearing in person before registrar.

In many districts parents have to be there otherwise your marriage is considered to be under Special Marriage's Act which involves police verifications and what not...

The Marriage solemnized according to Hindu customs and rites is valid marriage and it is covered under Hindu Marriage Act.But marriage solemnized under Special Marriage Act that there is needs of three witness and it is covered under any religion or community.

normally the witness not necessary. mere photo, marriage invitation is enough. one steps more will be registration of marriage . For which three persons required.

There is no set formula to establish a Hindu Marriage and there is no such set requirement of male/female witnesses before court of law. Mere affidavit of petitioner is sufficient if not opposed by other party.

When a Marriage is registered with the registrar then only the witnesses are required otherwise no witness is necessary for the marriage.

No witnesses are not required in Hindu Marriage. Hindu consider to be a Sanskar in which ritual are more important rather than witnesses. The mandatory condition for a valid Hindu Marriage is Saptpadi. However, parents and friends present in the marriage can be considered as witnesses to the marriage.After After marriage, the same can be registered under Section 8 of the Hindu Marriage Act and said certificate can be used as proof of evidence of marriage. For registration the witnesses present in the marriage are required to give their affidavit and for identifying the parties.

1. If both the parties are Hindus, the marriage can be gone through under Hindu Marraige Act.If one of them is not a Hindu, the marriage cannot be performed under HM Act.
2. If one of the parties is not a Hindu, the marriage can be gone through under Spl Marriage Act only.
3. For performing a Hindu marriage witnesses are not necessary but as registration is now compulsory, witnesses will be required for that.
4 Even in the case of a Hindu marriage, it is desirable to keep a record of the marriage by preserving the invatation card, photos of the couple at the time of marriage and of those present at the function.
