(Querist) 22 October 2011 This query is : Resolved
sir,
in district consumer forum order passed against me i fer forukiled appeal in state consumer forum, there i directed to deposite the amount in district consumer forum , i brought the DD in the name od PRESIDING OFFICER DISTRICT CONSUMER FORUM ,now presiding officer is saying i should have to take DD in the name of the party ,,
is it true ,,,,,because until disposal of the appeal DD is not dipersable ,

is there any rule that i should buy DD in the name of the Party ,
is there any rule that i can buy DD in te name of court

certainly the the DD should have been in the name of the party...the court is not a party to the dispute.

the DD can be revalidated at later stage...or see provisions whether the local Consumer forum is accepting the case amount instead against the said case and thereby issues receipt for the same.

you can ask the forum for acceptance or than alter the DD in the name of the party and take receipt against the deposit of the DD.

do as advised by Shri Kiran Kumar.

It all depends upon the language used in the State Forum's order. It is general practice that Amount is deposited in the Forum and after conclusion of appeal the concerned party i.e. Appellant or Complainant shall get from the Forum. If before the final verdict of appeal amount is given to the Complainant then entire purpose of appeal shall become infructuous.

agree with mr bhagat

Yeah!Mr.Bhagat is right. It all depends on language of order passed by state forum.

In my opinion you along with DD move an application in the state forum that in compliance of order you made the DD which District forum is not accepting.

Yes I agree too.
