i am central civil servant clerk. i am doing night shift. i wish to pursue b.ed degree course from a regular course during day. should i ask permission from my superior. shall i have to forfeit my salary during the study period. kindly mail me. thank u

you will have to take permission from your superior. You said your's is night shift then you will have no problem to continue your study and you need not to forfeit your salary.

Being the govt employee, you should get the permission, for perusing any full time course.

You should remember that when you are a government servant, you are a government servant all the 24x7 hours. It may be that your office timings may be either 9 to 5 or night shift, but that does not alter the position of your being a whole time government servant. Today you may be in the night shift, there is reason why you cannot be shifted to day shift any time. Whether they shift you to day shift or not, still you have to take No objection certificate from your office / controlling officer before you join any regular course. If you do not do it now, then it will become too late. In future employment on the basis of the B.Ed., they may ask how did you study when you were in employment during the relevant period, since you were in employment. They will ask whether you took permission from the employer for pursuing the study. Then you will get stuck. But this requirement of taking permission from the employer will not arise in case you are pursuing a course through distance education i.e. correspondence.

Dear Anonymous,

You cannot expect that your night shift cannot be changed to day shift, as according to FR 11, the whole time of a Government servant is at the disposal of the Government which pays him, and he may be employed in any manner required by proper authority.

As per Government of India Decision No. (4) below Rule 3 of the CCS Conduct Rules, permission of the Government is necessary for joining educational institutions outside office hours.

SO, you will need to take permission from the competent authority to join a B.Ed Degree Course.

However, you will not be required to forgo any part of your salary by doing so, as you would be joining the course only after before/office hours.

Doing any course while in employment,the no objection from the employer is a must,in each and every case,shift has nothing to do with it.

Permission of the Government, means permission as per the discretion of the government. If permission is not granted, the government will be well within its rights and it cannot be compelled to grant permission. In that case, if pursuing education is more important than retaining the existing job, you have to make a choice and quit the job to pursue your higher education.

Dear Anonymous,
Everything is possible, so long as everything goes smooth. Suppose, your office finds out in the meanwhile that you are pursuing a course and shifts you to day duty. How will you pursue the course. If the department issues a show cause as to why you have not taken the prior permission to join the course - what will you do? There are so many ifs and buts. Whatever that you will be doing henceforth would be doing so with clear knowledge of the consequences of your actions. You have to decide for yourself and take things as it comes.

It is better to take permission of the competent authority for the purpose of enhancing the educational qualifications of the employees that being not at the cost of the employer. Normally, permission is granted on application. Only in rare cases the permission if withheld.

No way...... they can't cancel the b.ed degree or any way it is void.

None can cancel your degree, except the university, who awarded that degree, that too only on finding you having used unfair means/cheating in exam.

The only thing your department can do is to treat you having committed a misconduct by not taking due permission from the department for pursuing your degree course and can take disciplinary action against you and punish you for that misconduct.

However, they can take disciplinary action against you. Shri R. Ramachandran and Shri P S Dhingra gave you perfect advise, as you need to adhere.Don't get confuse.

If concern authority unreasonable refuse to give you permission for B.ed. you can go writ jurisdiction subject to the CCS Conduct Rules.

If your office is not so far aware that you are pursuing B.Ed., then you have no other option, than to keep the matter away from their knowledge.

After completing the course, do not try to get the same entered in your Service Book for claiming your additional qualification. Do not even tell anyone, including those whom you consier as your closest friend.

We are not astrologers here. The State Govt. authorities may or may not create problem. It is all your making. You have to constantly live in fear. You have to take things in your stride. There is no other go.

If you get appointment with State Government with your degree, why the State Government would have any objection to your having a higher qualification?

Only your present employer can take objection, if any, to your not taking proper permission from the competent authority before taking up the course.

after resigning from the previous employer that is present central government employer how can the present employer object me for joining the state government as teacher with b.ed qualification.

These are all possibilities - not necessary to happen.
Scenario: I
1. I am a State govt. employee. You have been selected for appointment as a teacher. Now I have to check your original certificates of qualification. I find that you have your normal degree passed in such and such year; and B.Ed. Degree obtained in such and such year. I also come to know from your particulars, that you were in the employment of central Govt. during certain period. I chance upon to notice that you completed your B.Ed. when you were in employment. I know that you could not have completed your B.Ed. regular course while being in full time employment.
Therefore, as a curiosity, I ask how did you complete your regular B.Ed. course when you were in employment. You will say that since you were having night-shift, using the day time, you pursued the regular course. I being in the Government, and aware of the government rules and regulations, simply ask you whether you obtained prior permission from the Central Govt. to pursue your regular course. - YOUR ANSWER - If you say 'yes' then I will ask please make available the permission letter. If you say 'NO' then I will start doubting your integrity - I will report to my officer that I found that so and so has completed B.Ed. regular course while being in full time employment and he did not obtain prior permission from his employer. Please guide how to proceed further... Your trouble starts.

SCENARIO: II
2. I am a State govt. employee. You have been selected for appointment as a teacher. Now I have to check your original certificates of qualification. I find that you have your normal degree passed in such and such year; and B.Ed. I verified. Put remarks Originals checked and verified. YOU WILL HAVE NO PROBLEM. Unless subsequently, somebody rakes up the issue.

But be sure, you have not done any crime. It is a small irregularity. It should not bog you down. You should tell the truth and go ahead. Think positively. That's all.

i am central government clerk working in postal department. i have been awarded punishment for no fault of me by mere complaint of my immediate senior to the officer. i refused the charges fixed by senior to the officer. but the officer has awarded me punishment. what is the procedure to appeal against this punishment. the punishment is increment cut for one year. kindly mail me. i wish to know whether i have to go to cat or a suitable court or to the higher officer. kindly mail me.

Until you exhaust your departmental channels for justice, you cannot go to CAT. Even if you go to CAT without making appeal to the competent Appellate Authority, your case will be rejected.

In your case, your Appellate Authority is Director of Postal Services (DPS) of the Zone in which your Postal Division falls. You can get the information about the address of the DPS from the office of the Postmaster or staff branch of your Divisional Office.

SO, You can address your appeal against the penalty order to the concerned DPS through proper channel within 45 days of the communication of the penalty order.

Whosoever is the controlling authority of your Divisional Superintendent will be your appellate authority, may be DPS, Additional PMG or PMG, as would have been designated by your department. Instead of asking on this forum, you could better ask from the staff branch of your Divisional office about the correct designation of your appellate authority.

If still unable to get proper information, just address as "Appellate Authority" o/o the Postmaster General, ............... with proper address and send through proper channel.

Irrespective of whether it is a correspondence/ distance education course or a regular course, for admission to any educational institution for higher studies an employee in Government employment is bound to get due prior permission from the competent authority.
