sir,
my gift state that a market value of 9lakh but actual it is about 45lakh.
as well as the detail of my property ie i have 3 storied building,is not written in the gift .only area of the land on which the building is present is written in the gift.
the gift deed is immoveable property which is already registered for about 4 month but mutation is not done.
how to correct the structural details & market value of the gift?
we have contacted a new advocate he has told a new gift has to be done.

Dear Mr. Gaurav,
You yourself are not convinced about the adequacy of the writing in the GIFT DEED. If that be so, it would be better to get a proper GIFT DEED redrafted and registered, especially when the donor is alive and willing to execute the fresh GIFT DEED. This will save you from any possible future troubles.

you must not have given proper instructions to your lawyer . hence the problem . the complete details have to be mentioned in gift deed . go by your lawyers advice .

It is better to get registered clarification only on the earlier gift as a property once gifted cannot become part of subsequent gift. The donee is now owner of the gifted property which cannot be returned to the donor for even correction therein. It has already been registered nd possession handed over the donee so clarification or Explaination of Terms is the only remedy.

You need another gift deed with regard to the structure where the you need to mention about the previous deed as well.
This deed would also require registration and payment of stamp duty for structure.

Same question coming several ways.A similar advise as one that of Mr.Barman has been expressed here before by me,you are advised to follow or to desist from inquiring same thing several time.
