authenticity of bank document

(Querist) 15 June 2011 This query is : Resolved
I would like to know about authenticity of any bank document under Negotiable Instrument Act

PALNITKAR V.V. (Expert) 15 June 2011
Except the Banker's books of evidence Act, there is no presumption to any other bank documents like cheque bounce memo etc. Those have to be formally proved unless admitted by other side. Generally, cheque bounce memo etc are not disputed.
J K Agrawal (Expert) 19 June 2011
S 146 of NI Act is as under

1[146. Bank's slip prima facie evidence of certain facts.

The Court shall, in respect of every proceeding under this Chapter, on production of bank's slip or memo having thereon the official mark denoting that the cheque has been dishonoured, presume the fact of dishonour of such cheque, unless and until such fact is disproved.]
