recovery money suit

Dear,
My uncle has taken money from my father and he doesn’t want give it back. How do we get our money back? Is there any case we can file against him (i.e. recovery of Money suit ). Please note that my father has proof for all.It would be really appreciate if any one can me guide me or provide the solution for above of the matter.
The total amount will be more than 10lakhs.

Please note that my father has not given the money to my uncle directly; he has paid all the debts which my uncle has to pay.

Firstly give him a legal notice demanding the amount back, if he does not repay within the given time then, file a recovery suit in the court.

I think it is repeated question. Let it be . Issue legal notice to your uncle to repay the taken hand loan within( give him a time to pay the amount) otherwise file a suit for recovery of money. Keep in mind d yeras is the limitation to file a suit. You have not mentioned when your father has given a loan to your uncle.

Yes you can claim your money.. First issue a legal notice to your uncle. Then file a money suit against your uncle. If any promissory note is available mean you have to file with in 3 years from the date of promissory note
