Sir, please let me know, that trust is required to appoint auditor after its incorporation or else.

Hindu succession laws

A (Grandfather) acquired a land in 1940 on perpetual lease basis at his native place in Rajasthan and constructed a house on it, herein after referred to as the “said Property”. A spouse was B (Grandmother).

A (Grandfather) and B (Grandmother) died intestate in the year 1982, after coming into force Hindu Succession Act, 1956, and 2001 respectively , after coming into force Hindu Succession Act, 1956, leaving behind his only heir son C (Father) under the Hindu Succession Law governing them. C (Father) was married to D (Mother) and they had 5 children E (Granddaughter), F (Granddaughter), G (Grandson), H (Grandson) and I (Grandson).

C (Father) and D (Mother) made a joint will in the year 2009. Under the Will the said property and other properties and assets were to be given to survivor of them (ie vice versa) and after the death of both the said Property will be given to I (Grandson) only. C (Father) died in 2011 and D (Mother) died in 2021 leaving behind E (Granddaughter), F (Granddaughter), G (Grandson), H (Grandson) and I (Grandson) as their heirs.

Now question arises whether the said Property will now go to I (Grandson) as per will of C or will be equally divided between E, F, G, H and I (All Grandchildren) as an ancestral property (HUF)?

Promotion related issue

Sir/Madam,
I have been denied promotion though I was 4th in the Seniority list out of 9 and having 1st or 2nd in terms of pre-interview marks. Interview marks consists of 10 marks only. I was having 3 to 4.5 marks more than other candidates. Three candidates who joined one year later to me promoted ahead of me. They become equivalent to me because of the changes in promotion policy from 4 to 3 years over a period of time. Once they got promotion in 2.5 years as well with retrospective effect (Promoted in December but with effect from June in 2.5 years). Candidates who got promotion were 1, 6,7 & 9 in the list out of nine. I already a wrote letter to the management seeking reason for non-promotion. I am working in a PSU (Central Govt undertaking). Kindly guide me on this matter.

Written arguments in criminal appeal

Dear Sirs,
There is a criminal appeal against an acquittal, and the case has been dragging on for 5 years. Lawyer argued already but the judge was transferred and he argued again after the new judge came, However opposite party is simply dragging the case, may be they are waiting for this judge also to be transferred. One suggestion was to submit written arguments and leave it to the court. But lawyer has lost interest in this, earlier he did not object much when opposite party was taking adjourments on every date. Lawyer is already paid in full. Now can the party submit written arguments himself, or should it be with a lawyer only. Also as a layman, if there are any errors in wording or langauge, will that be a serious issue? Please comment.

Nhai tax relief bonds

After the death of the investor, nominee is the trustee of the bonds till it matures. In case the nominee also expires before the maturity and the investor already deceased, what happens to the bonds after the maturity? Is there any provision for the nominee to nominate when he is alive in case of tax relief bonds? I am 64 years old and my wife who is the nominee now, is aged 55 years. After my death, whether my wife who is the nominee can further nominate my son? Pl clarify.

My wife want maintenance of 90000 rupees under crpc 125 sec

Dear Team,

I was married in dec 2020 and she came to my home at jan 2021.She dont talk with my family member and she used to talk around 2-3hr on mobile. she dont perform household work properly and had bad habit to sleep for 4 hr in afternoon. For the same bad habit if my parents advice her the she starts quarrel. she dont respect my parents. Also she used to go back to her parents house on weekends twice in a months for any silly reasons.

My wife left my home after 5months with silly reasons. During last month i was infected with corona for around 1 month and was in home isolation. 7 days i was admitted to hospital and on oxygen and saline support only. Along with me my father and brother also corona infected and mother was ill.

She first file false police complaint and then she started threating me as her confidence boosted by false police complaint. She repeatedly saying me that my mother and father are destroying my life and she threatens me to file another complaint against my parents.
One day i discussed this problem with my parents and decided to take her to police station in order that police will try to resolve this problem. At police station she directly told that she dont want to live with me and given written complaint mentioning the same.
After next week we have counselling date at mahila cell at that counselling she said that she do not want to live with my parents but can live with me. But i said that i want to live with parents and my wife. so matter not solved..

After 2 months i got court summon for crpc 125 maintenance and Domestic violence case. In crpc 125 she demanding 90000 per month as maintenance and my salary showing as 1.8 lac per month.

Can any one help me regarding this issue?
how much maximum maintenance amount i need to pay if my salary is 1.8 lac.?
How can i avoid to pay maintenance amount beacuse she left home on her will but she also file false domeatic violence case?

Admissibility of whatsapp screenshot as an evidence

Good Morning sir,

I have a query regarding Admissibility of WhatsApp screenshot in court of law in India.

If someone has deleted his part of communication in WhatsApp chat and then taken his screenshot, Will that screenshot be admissible in court of law?

In my case the opposite party has deleted his messages and took screenshot. My problem is that even I have deleted the chat. Pls share your legal and technical opinion.
