Muslim law of settlement

wife settles her property to her husband. The husband with his two sons settle the said property to the only daughter and the mothers stood as witness. Is it permitted in the Muslim law? can the father and the two sons having settled the property in the daughter's name revoke or cancel the settlement deed as per the Indian Muslim Laws?

Property sold by power agent after the death of the author of the power of attorney

my father was owning a property(self acquired) and without our knowledge, and after several years(15 years)of his death we came to know that the property was sold to some promotor who constructed flats on that property and sold it to several flats and the flats owners are in their possession of the said flats. We found that our father's
property was said to be sold by his power agent and the sale was executed after my father's death. In fact my father did not execute any such power of attorney and even if it is executed it could not be used after his death. Now what we could do legally to nullify the sale executed in the absence of my father and restoring the property to our favour and whats are all the rights of the promotor and the current flats owners? please explain and advise me

Property Registration Authorities demanding more stamp duty

I bought a property of vacant(agricultural) land in May 2005 and availed concession U/s.47(A). The Registering authority retained the Document and demanded more stamp duty after an inspection by themselves along with the Revenue Department officials. I paid as per their demand in Nov, 2005. Even after that they were demanding higher stamp duty stating that it is added in the nearby Municipal limits and its guide line value is increased. The land is still situated among the agricultural land and paying agricultural tax and is on the basis of the nearby river. I sent a reply letter through a lawyer stating that it was already revalued and the difference deficit stamp duty was also paid. But they were in practice of sending notices for enquiries in Collector office and due to my family circumstances i could not attend. Now a letter from the Inspector General of Registar has come and attend for an enquiry on the matter above mentioned demanding nearly Rs.4,53,000/- deficit stamp duty. Please advice me what shall i do? How to handle the situation.

Cheque dishonours case- Recallof non bailable warrant

In a 13n N.I. Act, i am the complainant.The accused filed cor quash petition in the High Court and it was dismissed. He filed another petition for the dispensement of his appearance and the High Court gave only six hearings for which he need not appear and after that he should regularly appear and co-operate with the complaint for the 138 case. But the accused is absent from the year 2001 and court issued NBW against him. Now after nearly 8 years, he filed petition for recall of the NBW stating he was under a wrong impression he need not appear before the trial court after 6 weeks. I searched for relevant case laws in support of my proposed version that the warrant should not be recalled unless otherwise he should assure that he would not absent for the trial hereafter and also should deposit the twice the amount of the cheque with the court(Cheque amount is Rs.5,00,000/-). Now can anybody suggest me any other better condition that this and i may also required for authorities in this regard and also to secure the amount of the cheque

Posting it again for your suggestions. what is the next step after the appeal dismissed by the Central excise Tribunal?


In an appeal the Central excise Tribunal dismissed the appeal on the basis of no compliance of its interim order(stay order and to deposit Rs.8,00,000) within the stipulated time. Now what is the next step i should adopt?
For your nutshell the case is:-
Being a job worker i undertake orders from a company. I undertake only a small works of the total finished product. I am clearing assemblies upon payment of excise duty including value of the inputs put by me and in my cost. The company concerned sends me some free inputs for the assembly and i am neither accounting nor taking credit on that and the value of such free inputs or not included on the service charges. The excise authorities sent show cause notice to me mentioning that during the past two years i havenot included the free inputs and demanded excise duty of Rs.15,00,000/- and the penalty of Rs.15,50,000/- under sec 11A(2)CEA, read with Rule 6 of Central Excise Valuation Rules 2000 and for penalties sec 11AB, Sec. 11AC ibid under rule 25 od CE rules 2002. Agreived against i preferred appeal to the Commissinerand they reduced the Penalty to 8,00,000/- and confirmed the rest of the order. Again I preferred appeal in the Tribunal and obtained stay for the operation of the lower order with a direction of depositing Rs.8,00,000/- with in a short period of time and since i could not mobilise i sought further time and even after that time i could not deposit the money and hence my appeal is dismissed. I am financially in a bad position and my other properties are in the bank for loans and the factory concerned also could not run for the past one year. I even though of filing insolvency petition.
This is my position now. Kindly advise me whether i can appeal to another forum - High Court?. Is it possible can i give insolvency for this Central Excise propblem while my properties are in the banks and case is pending in DRT and the bank has right for the first charge over the properties.? Your valuable advice sought

How to handle a worker's notice who left the organsiation ?

I sent a worker who was not co-operating with other workers and amount is also settled in March 2008. He was working in my company for more nearly 4 years and in the middle of the above tenure his service was terminated twice. Now after 4 months he sent a registered letter(Not a lawyer Notice) that removal him from the service illegal and all the settlement benefits have not been given and hence to reistate him. My company is a small printing company and only 5 workers are working and no formal appointment letters are not given. Even ESI is also not covered due to the low number of employees. The said workers was mischievious and who was interacting with another worker who also left started similar business in our area. He joined with her now after the removal and giving maximum mental torrtures to me by way of anonimous letters, sms and phone calls.
Now kindly advise me what are all the legal rights he possesses to claim any amount from me. What are all the precautions i have to take to prevent further complication in this matter.
