Suit & Writ

(Querist) 15 May 2010 This query is : Resolved
Pls. let me know the Differences between A suit and Writ?
Daksh (Expert) 17 May 2010
Dear Mr.Vikas Thukral,

Proceeding on the original civil side jurisdiction in District and High Court (depending upon its pecuniary jurisdiction) by filing of plaint are numbered as suit and are governed by Code of Civil Procedure.

On the other hand A Writ lies under Article 226, 227 and 32 of the Constitution of India where State or its instumentalities are party to the proceedings. A Writ can lie either in High Court or in Supreme Court.

Best Regards

Daksh
