Help in lodging a FIR

(Querist) 10 May 2010 This query is : Resolved
Sir
I am living in a house which I have inherited after my fathers death and one of my fathers brother is staying in a portion of the ground floor with his family and was supposed to leave the house along with his family after my fathers death is not vacating and troubling us by stopping our water supply and using foul and abusive language. Two weeks back I talked to my Uncle and told him I will get switch put separately to boost up the water and I went with the plumber three four times but they kept on refusing and asking us to come later. Then I went downstairs and opened the door and got the work done after which my Uncle came and started abusing/threatening us and beating up the plumber. He even picked up a stone to hit him on his head so two three of us caught him to stop him. Then we went to police station and lodged a complaint and got the medical examination done for the plumber though he was saved and had minor bruises. Also we have CCTV footage of the incident which I have shown to the SHO and DCP but they are hesitant and not lodging an FIR as Uncle is a senior official in the government. Please advise what I should do to get an FIR through court, what is the process and how long does it normally take as now they are further threatening us that police will not take any action on them and they will get away scot free

file a criminal complaint in Magistrate's court....approach some local lawyer to get the matter drafted and filed.

If the local police is not registering the FIR then you could either lodge a complaint before the SP of the concerned District or file a complaint u/s 156(3)OF CRPC stating all the happenings for sending it for investigation.

Agreed with the learned members especially with that of Barman suggestions of approaching the SP.
