Mental harassment from mother in law

Querist : Anonymous (Querist) 26 May 2021 This query is : Resolved
Hello,

My wife as a part of rituals have moved into her mother's house after the delivery and was supposed to return on the 90th day. My mother in law is not interested in sending her back and is creating issues. My wife is in support of her mother and have started talking very rudely to me and my family members. She is accusing me of a lot of things including harassment since 2.5 years, ever since we got married. I know it's just because of her mother she is saying all this and yes even my wife's childhood was difficult as her mother and father were living a seperated life. Her father doesn't have any stand or say in her house and all the decisions are taken by her mother. Her father is supporting us and has said that he has also been a victim of her mother's mental torture

What is your question or what relief do you expect by posting this query here?
Well, if she is rude and arrogant and not willing to return to the matrimonial home, you my issue a legal notice to her asking her to return to the matrimonial fold immediately or within a period stipulated in the legal notice and you may also inform her that if she is not returning or not complying with the demands made for restituting the conjugal relationship, then she may be liable for legal consequences for the legal steps that you would initiate against her for abandoning the matrimonial home.
You can consult a lawyer in the local and serve a legal notice

Kalaiselvan Sir my question would be related to what actions can I take against my mother in law as she is influencing my wife and brain washing her against me. Her intentions may be to get me seperated from my wife and serve a divorce notice and ask for alimony. I also want to know if there is a way I could involve police

Soon someone will advise you to file case for restitution of conjugal rights.

This is a guaranteed and time tested tool for husband to ruin himself.

Such action leave wife with no option to give true/false case of torture and dowry demand in order to justify her not being able to return.

This forum is full of such like queries.

Mr. Quesrist:
You should understand the underlying law in this.
Your mother in law is playing a safe game in this by not coming into direct attack on you.
She is influencing or inducing her daughter to do all such undesirable activities.
Even though it is a clear fact that she is the person behind all these troubles but you cannot take any action against her either through court or through police if she has not personally harmed you.
ave stated that your mother in law is influencing and brain washing her daughter to go against you.
Your wife is not a child nor a lunatic that she will act on the dictates of her mother.
Your wife is a matured adult hence any decision she takes against you is her own decision and she would be held liable or responsible for the consequences thereon.
Therefore you better decide what to do in furtherance instead of stretching your imagination to punish your mother in law without any evidence or being legally responsible for the debacles in your married life.

There is nothing that could be done vis-a-vis the alleged influence of the mother-in-law over your wife.

Settle the problem(s) / dispute(s) / issue(s) amicably by involving her father, relatives and other elderly persons of the society.
But avoid restoring to legal avenue /options which would aggravate the situation.
Consult and engage a local prudent lawyer for appreciation of facts / documents, professional advise and necessary proceeding if you and your family feel very strong for destroying matrimonial life.
Advocate Bhartesh goyal (Expert) 28 May 2021
No legal action can be taken against your mother in law on given facts.
