Documents relating to property

(Querist) 16 July 2020 This query is : Resolved
If the agricutural land is purchased and then NA permission is taken. But the entry in 7/12 records shows that the land is still agricultural land then what will be the process to show non agricultural land?
Guest (Expert) 16 July 2020
There is nothing to worry about. 7/12 documents is a record of Lend Rights. It is used for looking up the Ownership of ancestral land in villages and it would also disclose the litigation if any earlier in that land It is applicable to both agricultural and non agricultural lands. You had already obtained the NA and certainly there will not be any issues in future. You could confirm it with the concerned Department for your satisfaction please.

1. Agricultural Land has been converted into NA Land, THEN it compulsory to have it duly recorded in the Revenue Records, for payment of Land Revenue Taxes.

2. IF knowingly you pay agricultural tax instead of N.A. Taxes, THEN status of land shall remain disputed, for all futuristic legal purposes and also during any futuristic Public purpose Land Acquisition Proceedings.

As per me, you purchased the agricultural land and taken permission to NA. After taking permission did you converted the land into Non-agricultural land i.e. into plots/layout? Still, you won't make a layout the Land Records shows the name in 7/12 adangal(Pahani).

Land records, 7/12, are maintained by revenue department.
Conversion of agriland into residential (or rarely industrial) land is not done by revenue department.
The information may not sent to revenue department.

You intimate to Tahsildar enclosing the land use conversion order for mutation.

NA certificate for agriculture land shall have to be taken before registration as non-agriculture, which can not be ex-post-facto.
However, if it is already registered as "NA" intimate the fact to revenue authorities with documents.

Get the fact of NA land noted with the revenue record through revenue office.

In Maharashtra, conversion to NA purpose is done by the revenue Department. However, the conversion has not been been noted and recorded by the local Talati. You may take up the matter with him.
Rajendra K Goyal (Expert) 18 July 2020
Why the fact of NA was not noted in the revenue record?

Have you tried to get it noted?

If so, what was the response / objections?
