Problem faced after selling housr

I am from Chennai. I sold my house measuring 600 sq ft which I got from my father through settlement deed. There is a 24 feet road on the left of our house. Now the house owner on the other side of the road threaten to file case on the buyer of our house for occupying 4 feet of that road. Whether the buyer can file any case on us. How to handle this. Please guide.

PS. If we measure road roughly it is around 20 feet instead of 24 feet. His layout map mention 24 feet. We are in no clue how it has happened. We paid property tax promptly for our 600 sq. Ft house. Our house built without building plan approval.

What is the ground on which the buyer is being threatened? Had the house been constructed after obtaining permit for construction and the local body has occupancy certificate and assessed to property tax?

Hello,

If you are trying to grab road area it is illegal act. Moreover you have not approve the house plan. So discuss with him and try to find amicable solution.

If 4’ land of road has been included in your house and hence sold out, you are at fault and can be in trouble.

Otherwise, you have sold the land, there is no liability of yours in the dispute with neighbor of purchaser if neighbor has grabbed before or now any land from Road.

Amicable settlement is always preferable.

Encroachment of the public road is not a matter between two individuals rather State/Municipality is an important party. It shall be better to get the matter settled mutually so that none may make complaint to the municipal authorities otherwise illegality shall remain illegality for ever.

If your house is having encroachment, it is illegal, if he complaints, it has to be removed. If constructed, construction would be demolished.

Same case would be with the neighbor if he proceed for encroachment.

The author ha since modified his posting. The posting, originally, read as follows:

The second para is a subsequent addition. Such action is improper and amounts to taking those who contribute to this forum for a ride.

not a good habit if original query is changed subsequently.
If the property sold is not in accordance with the property handed over, the title is defective in any way, buyer can sue the seller.
