Parking

Querist : Anonymous (Querist) 19 June 2020 This query is : Resolved
I live in a G+3 complex and there no car parking space inside the complex, I park my car at the front of the neighbor house 3 meters beside the gate in front of a wall.
and the neighbor also has sufficient space to park his own vehicle.

1. Can the neighbor object me for parking my car beside his gate in front of a wall on a public road?
2. what rights do I have against the neighbor if he does not allow me to park my car?
Raj Kumar Makkad (Expert) 19 June 2020
1. Yes, he can.

2. Nothing.

Everything in life is not based upon legal rights rather it requires good understanding and relationship. You need to adopt both these rights and liabilities also so that neighbour may not only allow you to park your vehicle tere but also make you a part of his life and family.

Very well analysed and advised by expert Mr. raj Kumar Makkad, I fully agree and appreciate his acumen.
You have no right to park your vehicle adjesent to neighbours wall, wherein he may or may not object.
More than right mutual understaning works in such circumstances.

read terms and conditions.

There need not be any ground for objection so long as ingress and outgress is not adversely affected. There are legal provisions as to how vehicles could be parked in a public road.

Reply:

You have no right to park your vehicle on public Road, specifically before the residence of others. You have no cause of action against neighbor on this issue.

1. You do not require any permission to park on Public roads provided you are not restricting anybody's access.

2. Similarly neighbor has no right to object to anybody parking on Public roads. However the Police /RTO /Municipal have every right to tow away your vehicle which may be parked on public road.

None has got any right to park his vehicle in front of his gate. This is definitely a hurdle in outgress and ingress in that particular neighbour.
Rajendra K Goyal (Expert) 22 June 2020
The owner may object if the neighbor’s vehicle is parked before his house, although parking may not be before his gate.

Municipality / Traffic police has right to toe away if parked on public Road, however in every city vehicle are parked on Road.

If the neighbor is not having any vehicle, one should park after taking him in confidence, after his consent.

Definition of quality differ from person to person.
Everyone has right to consider his advice is best, with no right to consider other as baseless.
Difference should be respectful on law point not with any person.
