Summer holidays are not the part of notice period?

Dear Team, I am a teacher working in a reputed CBSE school. Now i secured a better job and i need to quit form my present school. As per school policy i gave my resignation and 3 months notice period on 7/4/2018. My notice period include moths of April, May, and June. But in May we have summer break for 25 days i.e. from 6th of may to 26th of may. Now today on 10/4/2018 i got a message form my principal that notice period includes only working days, therefore my notice period will end in the month of July. But in my appointment letter it is clearly mentioned that notice period will be of 3 months not 3 months of working days. So kindly guide me to take the right step and with your guidance i will approach them. If any website on which details regarding notice period is available so please send the link to me so that i will meet them with all documents in my support and all proofs.

On the face of IT verbatim as per words posted by you the interpretation posted by you may not be wrong..................

You may post the link to service rules of establishment, the directions by Directorate of Education in your state....

Since you want to meet .as posted by you.............some websites........that might actually be some Lawyer/Law firm....

Declaration of inclusion of only working days might not be correct as otherwise also off days/holidays are included and are paid/payable like working days...



Approach a very able senior LOCAL counsel of unshakable repute and integrity specializing in Labor/Service matters and having successful track record ….. and worth his/her salt …with all record for a considered opinion…

Inquire at LOCAL Labor courts/CGIT/Educational-School Tribunal/CAT/Civil Courts/HC/SC...............

Only absurd advice can be expected from Mr. Kumar Doab, as fake expert. He made two posts, but without any meaningful advice, just to add scores to his credit for appearing two times on the website.

No law says that summer vacation period should be subtracted from the notice period. You may just ask your principal to quote any section of law under which the notice period would not include the summer vacations.

You may inform the principal, preferably, through a Lawyer that a plain reading of the terms and condition cannot contain or sustain such an extraordinary interpretation. It is elementary that the terms of any contract needs to be understood in the ordinary parlance.

If your principal is merely a duffer, he/she can assume anything at his/her sweet will. If he/she believes only in working days, he/she should also have counted Sundays and other holidays happening in between the working period other than summer vacations.
