sir,
can 340 cr.p.c. application not pressed before d court?
if yes ,dn appairence of applicant is must?

Proceeding under section 340 C. PC is initiated on the part of concerned civil court which can be prayed by the party affected. As it is a civil suit, the presence of the party praying is not required in person. Criminal section relates to court not to the affected party praying.
