Property verfication

In case of registration of property, I am the purchaser . So I have to Pay the stamp duty . But is it necessary to get legally consent from the seller that he wants to sell his property to me? As if he denies later then 10% of my stamp duty will be cut off even after refund. What should I do ?

The deed writer usually covers in draft of sale deed that the buyer shall appear for registration of sale deed on dated .....................and in case he/she does not he/she shall bear.................

If you have suffered any loss either settle amicably or approach your lawyer to approach court.

1) It is not necessary that the Purchaser has to pay the stamp duty charges. It is to be decided mutually. Even the seller can pay the same.
2) The consent of the seller that he is selling the property to you is a specific clause mentioned in the deed of the conveyance which is to be executed by both you.
3) About any cut off or refund of any amount, mention a specific clause in the sale deed or agreement.

Go thru the T&C of agreement to sell, draft of sale deed that you have, carefully, and you can find out what is possible in your case………..
Try and resolve amicably, if possible.
Or handover the case file to your own very able LOCAL senior counsel of unshakable repute and integrity specializing in such/revenue/civil matters and having successful track record.

You may proceed as deemed fit to you at your end.

Get the agreement to sale executed containing all conditions, agreed date of sale agreement, amount paid as token money, who is to pay stamp and can get the property registered through court orders if other party refuses.
