Dear All.
i was in relationship with a girl with consented physical relation. later i realize that her behavior is not normal she always lie. hence i decide to break up when i let her know she has threatened me to file the case u/s 376
pls clarify :- will it amount to rape. will police or court send her for medical examination. will medical report reveal that it was not rape.
pls let me know how it save my life.........

Seems to be purely an academic query.
By the way, how do you come to know about section 376, if you are not a law student?
However, if any reality is there in your story, let the girl file a case u/s 376 against you. What action the police or court takes cannot be predicted by any expert.
About your question, "pls let me know how it save my life........." by the way, if you are made to know that your physical relation tended to fall under the scope of rape, what you would do to save your life without fighting the case to prove your innocence?

Serious issue if it is genuine..
If it was a consensual relationship then it does not amount to rape. But as it is a serious offence, police might file FIR against you with some influence. Never ignore the call from police station if the police wants you to appear at the station before filing FIR. Appear with the available evidences of your relationship with the girl. You might need a good lawyer.

If there is even slightest of truth in your story and the girls files a case against you, you won't have any option except to fight the case on merits or have some compromise with the girl on her terms. If you take that lightly that will cost you quite dearly.

Dear sir,
its my real query not academic. pls let me know does our life depends completely on the girl first both we have physical relation. later due to any problem the girl all of sudden came out say you raped me. in that case what about the medical examination. is it necessary in such case. will the medical report may reavel that it was not force relation.
pls share your views......

When she has not yet filed any FIR, where the question of medical examination arises. Wait for the FIR to be lodged against you and what action is taken by the police on the FIR.
Rather, this very premature question about medical of the girl, without any FIR lodged so far, clearly hints towards the academic query for which you seem to be seeking answer to solve, not solution to any real problem.

again i am saying its real case not academic also i am not lawyer.
yogen sir... actually i only have phone conversation as evidence of our relationship but i am panic if she file case then how i will prove she was not raped. what may be the evidence that is to reveal that it was consensual phydical relation.
And dhingra sir.... according to you what should i do should i wait to lodge FIR against me should i wait to get me arrest by police should i let her allow to ruined my life. i am so sorry to admit that you view is not satisfactory.

Cause of action has not yet arisen. Action becomes due only according to the offence, if reported by the girl.
No further suggestion is called for without there being any cause of action.

If the data is recovered from the phone of the girl (original complainant) it shall help you in your defense. Even otherwise as I stated, your lawyer shall be strong and confident enough to defend you in such case. The case certainly falls within the criteria of consensual sex which has many judgments which you can apply in your defense.
